A trademark registration certificate gives legal protection to your company name, your logo or the signs that distinguish your products. For lift companies, trademark registration is the basis for placing lifts on the market under their own brand, and it is also among the documents required for the TSE Service Qualification Certificate. CMB Consultancy supports your company throughout the trademark application process.

What Is a Trademark Registration Certificate?

A trademark is a sign, such as a word, figure, logo, letter or number, that distinguishes the goods or services of one business from those of other businesses. In Türkiye, trademarks are registered by the Turkish Patent and Trademark Office (TÜRKPATENT) under the Industrial Property Law No. 6769. A trademark registration certificate is issued to the owner of a registered trademark.

Why Is It Important for Lift Companies?

  • Placing products on the market under your own brand: It allows you to offer your lifts and services under your own brand. Together with the CE certificate, it forms the legal basis for putting your own brand on your products.
  • Service Qualification Certificate: The trademark registration certificate is among the documents required for the TSE Service Qualification Certificate under TS 12255.
  • Protection against imitation: The owner of a registered trademark can take legal action against unauthorised use and imitation of the trademark.
  • Commercial value: A registered trademark is one of your company’s assets; it can be licensed or transferred.

How Does the Trademark Registration Process Work?

  1. Trademark search: Before applying, a search is made to check whether an identical or similar trademark has already been registered or applied for.
  2. Choosing classes: The trademark is applied for in the classes of goods and services in which it will be used (Nice Classification). For lift companies, class 7, which includes lifts, and class 37, which includes lift installation, maintenance and repair services, are the most relevant.
  3. Application: The application is filed electronically with TÜRKPATENT and the application fee is paid.
  4. Examination: The application is examined for formalities and substance.
  5. Publication and opposition: An application that passes examination is published in the Official Trademark Bulletin; third parties may file an opposition within two months of publication.
  6. Registration: If no opposition is filed, or if oppositions are rejected, the trademark is registered once the registration fee is paid, and the trademark registration certificate is issued.

How Long Is a Trademark Registration Valid?

A registered trademark is protected for 10 years from the filing date. This period can be extended for further periods of 10 years by filing a renewal application. Not missing the renewal deadline is important for continuous protection of the trademark.

What Is Needed for a Trademark Application?

  • the applicant’s identity or trade name details,
  • a specimen of the trademark to be registered (logo, wording or a combination of both),
  • the list of goods and services (classes) for which the trademark will be used,
  • confirmation that the application fee has been paid.
